On September 29, 2003, the Ministry of Commerce of the People’s Republic of China (hereinafter referred to as the Investigation Authority) published MOFCOM Announcement No. 48 of 2003 and decided to impose anti-dumping duties on imports of polyvinyl chloride originating in the United States, South Korea, Japan, Russia and Taiwan Region for five years starting from September 29, 2003.
On September 29, 2009, the Investigation Authority published MOFCOM Announcement No. 69 of 2009 and decided to extend the anti-dumping measures against imports of polyvinyl chloride originating in the United States, South Korea, Japan, Russia and Taiwan Region by five years starting from September 29, 2009.
On September 28, 2015, the Investigation Authority published MOFCOM Announcement No. 36 of 2015 and decided to extend the anti-dumping measures against imports of polyvinyl chloride originating in the United States, South Korea, Japan and Taiwan Region by three years starting from September 29, 2015 and terminate the anti-dumping measures against imports of polyvinyl chloride originating in Russia starting from September 29, 2015.
On September 28, 2018, responding to the application of the polyvinyl chloride industry of the Chinese Mainland, the Investigation Authority published MOFCOM Announcement No. 68 of 2018 and decided to start expiry review investigation into the anti-dumping measures applicable to imports of polyvinyl chloride originating in the United States, South Korea, Japan and Taiwan Region from September 29, 2018. The Investigation Authority investigated the possibility that dumping of imports of polyvinyl chloride originating in the United States, South Korea, Japan and Taiwan Region would continue or occur again in the Chinese Mainland and the dumping would continue to cause damage or would again cause damage to the polyvinyl chloride industry of the Chinese Mainland if the anti-dumping measures were terminated.
On September 24, 2019, the applicants of the case - Xinjiang Zhongtai Chemical Co., Ltd., Xinjiang Tianye (Group) Co., Ltd., Shaanxi Beiyuan Chemical Group Co., Ltd, Tianjin Dagu Chemical Co., Ltd. and Yibin Tianyuan Group Co., Ltd. - applied for cancellation of the expiry review investigation and requested the Investigation Authority to terminate the expiry review investigation into the anti-dumping measures against imports of polyvinyl chloride.
The Investigation Authority decided to accept their application after it examined the case. According to Article 27 of the Anti-dumping Regulations of the People’s Republic of China (hereinafter referred to as the Anti-dumping Regulations), the Investigation Authority decided to terminate the expiry review investigation into the anti-dumping measures against imports of polyvinyl chloride originating in the United States, South Korea, Japan and Taiwan Region and terminate the anti-dumping measures applicable to the investigated products on September 28, 2019. No anti-dumping duties shall be imposed on imports of polyvinyl chloride originating in the United States, South Korea, Japan and Taiwan Region, starting from September 29, 2019.
